Terms of Service

1. Introduction

By accessing or using the SwiftUI Template private GitHub repository ("Product"), you confirm your acceptance of, and agree to be bound by, these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Product.

2. Agreement to Terms

This Agreement takes effect on the date you first gain access to the private repository after purchase.

3. License and Access

Upon purchase, you are granted a non-exclusive, non-transferable, revocable license to access and use the private GitHub repository containing the SwiftUI template source code. This license permits you to use, modify, and integrate the code into your personal or commercial projects.

4. Strict No Sharing and Redistribution Policy

  • Under no circumstances may you share, distribute, resell, sublicense, or otherwise provide access to the private repository, its URL, or its contents to any third party.
  • Sharing includes any direct or indirect provision of access, whether for free or for compensation, including but not limited to posting, copying, forwarding, or sublicensing the repository or code.
  • Such unauthorized sharing constitutes a material breach of these Terms and may result in immediate termination of your license, legal action, injunctive relief, and claims for damages to the fullest extent permitted by law.

5. Termination Rights

The licensor reserves the right to terminate or suspend your access to the private repository at any time, with or without cause and without prior notice, including but not limited to violations of the no sharing policy.

6. No Refunds

All sales of the Product are final. Due to instant and full access to the source code upon purchase, no refunds, exchanges, or cancellations will be provided under any circumstance.

7. Intellectual Property

All rights, titles, and interests in the Product, including all source code, artwork, branding, and documentation, remain solely with the licensor. You must change all product branding, bundle identifiers, and unique content before deploying any app built using the Product.

8. Updates and Support

The licensor may provide updates, bug fixes, and improvements at their discretion. Support is limited to installation and integration assistance via email. Custom development or extended consulting is not included.

9. Disclaimer and Limitation of Liability

  • The Product is provided “as is,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
  • The licensor does not guarantee that the Product will meet your requirements or that it will operate uninterrupted or error-free.
  • To the fullest extent allowed by law, in no event shall the licensor be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Product, even if advised of the possibility of such damages.
  • The licensor’s total liability under or related to these Terms shall not exceed the amount you paid for the Product.

10. Governing Law

These Terms shall be governed by and construed under the laws of Wyoming, United States, without regard to conflicts of law principles.

11. Changes to Terms

The licensor reserves the right to modify these Terms at any time. Updated Terms will be posted on the official website and will become effective immediately upon posting. Continued use of the Product after changes constitutes acceptance of the revised Terms.
